PUBLIC OFFER


for the conclusion of a distance sales agreement


The terms used in this Offer are defined at the end of the document.

This document constitutes an official offer by the Seller to conclude a distance sales agreement under the terms set forth below.



1. GENERAL PROVISIONS


1.1. Purchase of Products


You may purchase products on the Seller’s website:

eigenpersova.com


The sale of products is carried out remotely via the Internet.


Products are divided into:

ready-made products;

products manufactured according to the Buyer’s individual order.


Delivery of products is carried out by transportation companies. Delivery times are determined by the respective transportation companies and do not depend on the Seller.


The cost of courier delivery is paid separately by the Buyer and is not included in the price of the products.


The price of the products includes delivery by regional registered mail. Delivery by registered mail within Israel is also included in the price of the product.



1.2. Products Manufactured to Order


The production period for products manufactured to order is approximately from 2 (two) weeks to 6 (six) months from the moment the order is confirmed and full payment is received, unless otherwise agreed separately by the parties.


Products manufactured to order may be:

fully customized (unique design, parameters, materials, etc.);

partially customized (changes in size, certain characteristics, etc.).



2. SUBJECT OF THE AGREEMENT


2.1. The Seller carries out:

the sale of ready-made products;

the manufacture and sale of products made to order.


The Buyer agrees to accept and pay for the products in accordance with the terms of this Offer.


2.2. Orders are placed remotely via the Internet.


Electronic means of communication (website, email, messengers) specified on the Seller’s website may be used for placing orders and further communication.


2.3. Descriptions of the products, their characteristics, prices, and purchase conditions published on the Seller’s website form an integral part of this Offer.


3. ACCEPTANCE OF THE OFFER AND CONCLUSION OF THE AGREEMENT


3.1. Acceptance of this Offer shall be deemed to occur upon:

submitting an order request on the Seller’s website;

confirmation of the order;

payment of 100% of the product price;

payment of the agreed part of the product price.


3.2. The agreement shall be considered concluded at the moment the payment is received by the Seller.


4. PROCEDURE AND TERMS OF PERFORMANCE OF THE AGREEMENT


4.1. The Seller’s obligations shall be deemed fulfilled:

with respect to ready-made products — from the moment the product is handed over to the transportation company;

with respect to products manufactured to order — from the moment the manufactured product is handed over to the transportation company.


4.2. Together with the product, the Buyer shall be provided with a document containing information about the transaction and the terms for its cancellation.


4.3. Upon receipt of the product, the Buyer is obliged to inspect the product for quantity, quality, and compliance with the order.


5. CANCELLATION OF THE TRANSACTION AND RETURN OF PRODUCTS


5.1. Ready-made Products


5.1.1. The Buyer has the right to cancel a distance transaction in relation to a ready-made product within 14 (fourteen) days from the date of receipt of the product or from the date of receipt of the document containing the terms of the transaction — whichever date occurs later.


5.1.2. Cancellation of the transaction shall be carried out by sending a notification to the Seller via email at:

5.1.3. In the event of cancellation of the transaction, the Seller shall refund the amount paid by the Buyer.


The funds shall be credited in accordance with banking processing times, on average within approximately 14 calendar days.


The Seller has the right to deduct a cancellation fee of 5% of the product price or 100 Israeli shekels, whichever amount is lower.


The cost of returning the product to the Seller shall be paid by the Buyer.

The refund shall be issued after the product is received by the Seller and provided that the product shows no defects or signs of use.


5.1.4. The cancellation fee shall not be charged if the cancellation is due to a defect in the product, non-compliance with the description, or violation of the transaction terms by the Seller.


5.2. Products Manufactured to Order


5.2.1. Products manufactured according to the Buyer’s individual order are considered goods made according to personalized requirements.


5.2.2. The Buyer has the right to cancel the transaction:

within 3 (three) days from the moment the agreement is concluded;

or before the actual production of the product has begun, if production has not yet started at that time.


5.2.3. After production of a product manufactured to order has begun, cancellation of the transaction shall not be permitted, except in cases expressly provided for by the applicable laws of the State of Israel.


5.3.What is considered a defect in jewelry


5.3.1.Artistic Surface Characteristics

Some jewelry pieces created by the Seller intentionally preserve natural casting marks, micro-pores, small cavities, or surface irregularities that arise during the metal casting process.


Artistic stone setting may appear uneven to achieve the special effect of ancient stone setting and may also include additional holes in the metal.


These features are part of the artistic concept of the jewelry and are intentionally preserved as elements of the design.


If such characteristics do not affect the structural integrity, durability, or safe wear of the product, they are not considered manufacturing defects.


5.3.2.A defect in jewelry is considered to be a malfunction of locks and fasteners.


6. RIGHTS AND OBLIGATIONS OF THE PARTIES


6.1. The Seller shall:

provide the Buyer with complete and accurate information about the products and the terms of the transaction prior to its conclusion;

comply with the requirements of the consumer protection laws of the State of Israel;

ensure the confidentiality of the Buyer’s personal data.


6.2. The Seller has the right to:

engage third parties for the performance of the Agreement;

refuse to perform the Agreement before its execution begins if it is impossible to contact the Buyer using the contact details provided.


6.3. The Buyer shall:

provide accurate information when placing an order;

review the terms of this Offer prior to its acceptance.


7. LIABILITY


7.1. The Seller shall not be liable for violations of delivery deadlines if such violations are caused by the actions of transportation companies.


7.2. The Parties shall be released from liability for failure to perform their obligations due to force major circumstances.


8. MISCELLANEOUS PROVISIONS


8.1. This Offer, its conclusion, and its performance shall be governed by the laws of the State of Israel.


8.2. Correspondence between the Parties using electronic means of communication shall be recognized as legally significant communication.

TERMINOLOGY


Offer — this document published on the Seller’s website.


Acceptance — full and unconditional acceptance of the terms of the Offer by placing an order and making payment.


Agreement — the agreement between the Seller and the Buyer concluded through Acceptance of the Offer.


Buyer — a legally capable individual purchasing products for personal needs.


Products — jewelry products offered for sale by the Seller.

PROCEDURE FOR CUSTOM ORDERS


1. Procedure for Working on a Custom Product


1.1. In the case of an order for a custom product, the Buyer shall pay on the Website the base price of the product, which is preliminary and does not include the cost of additional materials, gemstones, increased metal volume, or other work that may be identified during the discussion and development of the product.


1.2. After the base payment is received, the Seller shall contact the Buyer within 3 business days in order to discuss:

the parameters of the product;

technical and artistic features;

production timelines;

materials to be used;

and other relevant conditions.


1.3. Following the discussion, the Seller shall determine the final price of the product within 7 business days, including, where applicable:

the cost of additional gemstones;

the cost of additional work;

the cost of additional metal volume (including increased product dimensions).


The final price shall be subject to mandatory approval by the Buyer.


1.4. After the final price has been approved, the Buyer shall pay the remaining amount within the period specified by the Seller.

Production of the product shall begin only after the full agreed payment has been received.


1.5. During the production process, the Seller shall:

select gemstones and provide the Buyer with information (photo / video / description) for approval;

after the gemstones are approved, produce and send the Buyer a wax model of the product for approval prior to the casting stage.


The Buyer has the right to request one revision of the wax model.


If the second wax model is also not approved by the Buyer, then at the Buyer’s choice:

the Agreement shall be deemed terminated, and the Buyer shall be refunded the amount paid minus the cost of work related to processing the request and producing the wax model;

or

further modification of the model may be carried out for an additional fee, the amount of which shall be agreed upon separately by the Parties.


After the wax model has been approved, refunds, cancellation of the order, or changes to the product parameters shall not be permitted, since this stage constitutes the actual commencement of production of the product.


ADDITIONAL PAYMENT PROCEDURE


2.1. If additional payments are required (including when modifying a ready-made product or creating a custom product), such payments may be made using various methods offered by the Seller, including individual payment links or alternative payment services.


2.2. All additional payments shall be confirmed by payment documents (receipts, payment confirmations, or transfer confirmations).


PAYMENT SPECIFICS


3.1. If the Buyer makes payment from the territory of another country, payment may be made upon the Buyer’s request using payment services or transfer methods available at the time of payment.


3.2. In such cases, the Seller shall issue and send the Buyer an individual invoice or payment details.


3.3. Work on the production of the product shall begin only after the funds have been actually received by the Seller.


3.4. Payments made outside the Website shall have the same legal force as payments made through the Website and shall constitute confirmation of acceptance of this Offer.
